Myths about Sex Crimes

Criminal Defense Lawyers Know that Myths Must be Challenged

Orange County Criminal Defense Lawyer Kenneth L. Schreiber has been protecting the rights of the accused for more than 40 years. Like all good attorneys who defend people accused of sex crimes, he knows that the United States Constitution is often neglected in such cases because there are so many myths about sex crimes. Too many people use these myths to convict the accused even before a trial has been conducted. Sometimes, guilt is already presumed simply because there have been accusations. If you have been accused of rape, child molestation or any other sex crime, you have an ally in Attorney Ken Schreiber.

American popular culture often uses fear to distribute myths about sex crimes. To Catch a Predator and similar programs make the public believe that anyone accused of a crime is necessarily guilty. In their zeal to get convictions and appear "tough on crime," federal investigators, police, sheriffs, and other law enforcement officials take advantage of this environment. If you have been arrested for a sex crime in California, call an attorney who knows how to call into question the evidence against you and show how popular myths may be contributing to unfair treatment.

The Constitution must be Defended

Convicting a person accused of a sex crime before they have even had a trial is unconstitutional, but it seems to happen all the time. Someone accused of a sex crime should not be automatically labeled a dangerous pervert. In fact, even people convicted of sex crimes are rarely a threat to the public. But myths endure:

  • "People accused of sex crimes are all the same." False. These crimes range from rape, to prostitution, to child molestation, to indecent exposure, to possessing child pornography, to statutory rape. Sexual offenses and people accused of sexual offenses are not all the same and the details of each case must be weighed before judgment is passed.
  • "All child molesters are disgusting pedophiles." False. Many people accused of child molestation have normal adult sexual relationships and do not have a recurring attraction to children that would qualify them as pedophiles. Often, accusations of child molestation are also false or they involve "victims" who appeared to be past the age of consent. But such details often get obscured by more salacious details and stereotypes.
  • "People who possess child pornography will commit acts of child molestation." False. Research shows that this is untrue. In fact, most convicted child molesters do not possess child porn. Watching pornography does not lead to rape and molestation. To say that it does leads to extremely harsh penalties for people who possess illegal pornography. And because this myth endures, the public supports outrageous penalties for possession of child porn.
  • "People convicted of sex crimes cannot be rehabilitated and will re-offend." False. Convicted sex offenders do not have a higher rate of recidivism than other convicted individuals. And, as is the case with all therapies, the results vary depending on the individual. Generalizations do not hold up under scrutiny and therapy is often very effective.
