California Felonies and Misdemeanors

Irvine Sex Crimes Defense Law Firm

At the Law Offices of Kenneth L. Schreiber in Irvine we handle a wide variety of criminal cases and defend clients accused in very high stakes criminal cases in California: white collar crime with millions of dollars in question; vehicular manslaughter where our clients are facing decades in prison; massive drug cases in which federal authorities want to seize our clients’ property and imprison them for life. These cases are all high stakes and we are prepared to defend you if you face such charges anywhere in Southern California. However, a growing need has been in the area of sex crimes. We have focused much of our practice on this area because our clients often face catastrophe if they are convicted.

The difference between felonies and misdemeanors in California

Sex crimes are quite often treated as felonies: child pornography, molestation, rape. A conviction for a felony may lead to more than a year in state or federal prison and will have significant fines attached. Some fines can run in to the tens of thousands of dollars and prison sentences can be into the decades and longer. Felonies are the most serious crimes and require an attorney prepared for the demands of defending a client against such charges. Orange County Defense Attorney Kenneth L. Schreiber can be reached for a free consultation at 949-852-0411. But, he is also prepared for dealing with the less serious but no less important misdemeanor charges that you may face.

At first appearance, misdemeanors are undoubtedly less serious than felonies. A misdemeanor can result in no more than a year in jail and may have a fine of no more than $1,000 associated with it. The severity of the crime you have allegedly committed and, if applicable, the types of injuries that resulted can be the difference between a felony or misdemeanor charge. Many of the following are often misdemeanors, especially for first offenses:

  • Indecent exposure
  • DUI
  • Assault & battery
  • Domestic violence
  • Certain drug charges

However, if you are a repeat offender in California—for the same crime or another—your case may be treated as a felony. For many crimes that are misdemeanors, if have been arrested repeatedly for domestic violence, indecent exposure or DUI, you may be charged with a felony for the same offense. Furthermore, if you have been arrested repeatedly for other crimes, prosecutors may try to impose the harshest punishment possible. Don’t let this happen to you. Fight every arrest as vigorously as possible. Call Orange County Defense Attorney Kenneth L. Schreiber whether you have been charged with a felony or a misdemeanor in Orange County or anywhere in Southern California: 949-852-0411.
