The following published cases demonstrate my law firm's ability to secure favorable outcomes for clients facing difficult legal issues. Mr. Schreiber was trial counsel in these cases. Matos Mr. Schreiber's client was convicted of battery on a police officer in Los Angeles County. On appeal, the court held that the firm's client was entitled to access to information about the complainants and witnesses to the events in question that had been denied by the trial court. The lower court judgment against Mr. Schreiber's client was reversed. People v. Thomas The firm's client was convicted of committing lewd and lascivious acts on the body of a child under the age of 14 years, and he appealed. In the state supreme court, the conviction was overturned because the trial court had improperly allowed evidence of prior similar acts by the defendant to be presented over Mr. Schreiber's objections. Such evidence was held to be too inflammatory and prejudicial for use in the defendant's trial for different acts, and further was held to have occurred too remotely in the past to have value to prove the newer charge. People v. Loomis The firm's client was convicted in of driving while under the influence of alcohol based on the admission of the testimony of the arresting officer over Mr. Schreiber's objections. On appeal, the San Diego County Appellate Department held that: The arresting officer could not testify as a lay witness or as an expert witness as to his opinion of the defendant's blood alcohol level based on a test the officer administered, and the deliberate destruction by the police of the identity of a citizen observer who was riding in the police car and who witnessed the defendant's arrest deprived Mr. Schreiber's client of due process of law. Because of the police misconduct, the DUI complaint against Mr. Schreiber's client was dismissed.
